1 Definitions
The AVIC definitions apply, in addition:
The Gridbuilder B.V., located in Monnickendam, at Kerkstraat 17, registered in the trade register under number 91892759 and registered with VAT number NL002985064B05, accessible via email info@thegridbuilder.nl, contractor, trading as The Gridbuilder;
You are the natural person who is not acting in the exercise of a profession or business to whom an offer has been made;
Parties: You and The Gridbuilder together;
Custom Quotation: the quotation as issued to You by The Gridbuilder with a description of the Work;
Installation: The components in accordance with the Custom quote, possibly including a solar panel system, control systems, electrical installation, storage systems, EMS and/or other components.
Agreement: the agreement for the Work based on the conditions as laid down in the Custom Quotation, AVIC and these General Terms and Conditions;
2 Customized energy storage
2.1 The Gridbuilder will properly prepare the energy storage quotation for your home / business. However, this in no way means that the Energy Plan can be regarded as a study within the meaning of the energy performance regulations of the Dutch government, into the energy performance of the building or an energy performance certificate. Nor can The Gridbuilder be considered an energy performance expert within the meaning of the aforementioned regulations.
2.2 For the design we choose when making our battery storage calculation, we take into account the energy consumption of the home / asset, the users, the desired storage capacity, the generation from solar panels and the total power of the asset. We opt for a technical design that best suits the specific situation and customer wishes.
2.3 You declare that you are aware that the savings, as calculated indicatively by The Gridbuilder in the quotation, are indicative and that the annual savings that You can realize with the Work delivered by The Gridbuilder partly depends on factors outside the The Gridbuilder’s sphere of influence, including:
2.3.1 variation in climatic conditions in any year (e.g. amount of sunshine, winter temperatures);
2.3.2 changes in your power consumption behavior;
2.3.3 changes in (flex) electricity prices;
2.3.4 Tax and regulatory changes.
2.4 The Gridbuilder excludes any liability for the factors mentioned in 2.3 expressly for the Work it has delivered
3 Delivery and execution of the Work
3.1 Components delivered to You for installation must be adequately managed by You and not damaged or disposed of until ownership has been transferred to You.
3.2 You declare that there is no asbestos present in the room(s) where the Installation is to be installed.
3.3 You have your own obligation to investigate the extent to which the noise level of the installation, which is specified in the Custom Quotation, is acceptable for yourself and your environment. There must also be sufficient ventilation
3.4 When installing the storage, the minimum and maximum ambient temperatures must be taken into account to ensure proper functioning.
3.5. The level of finish of any pipes/cabling never includes carpentry or repair work on cladding. These are always at your own expense.
3.6 You declare that the roof surfaces, floors, walls on which solar panels or battery storage are installed are in good structural condition. The Gridbuilder is not liable for damage caused by the fact that the surface such as roof or floor cannot support the extra ballast.
3.7 If a roof surface on which solar panels are installed is convex or concave, you are aware that the solar panels may not form a completely even surface relative to each other.
3.8 The Gridbuilder is never liable for deviations in the expected energy consumption or energy generation of the Installation.
The Gridbuilder makes every effort not to cause damage to the home / asset during the work. The Gridbuilder is not liable for damage that unexpectedly arises and that could not be avoided by exercising the normal caution that can reasonably be expected from professionals. Making boreholes is not considered damage.
4 Financing
4.1 If there are subsidy schemes, the Gridbuilder can advise on this
4.2 If desired, The Gridbuilder can provide you with information about the Work that can help you make a choice for a form of financing. The Gridbuilder does not act as an advisor or intermediary within the meaning of Dutch law. The financing is also not part of this Agreement.
5 Payment and cancellation of order
5.1 Unless expressly agreed otherwise in writing or electronically, payment for the assignment (including the Work) will take place in the following termines:
5.1.1 30% of the hardware total invoice order so we can order the hardware;
5.1.2 100% of the remaining invoice at the start of the Work;
5.1.3 Additional work invoice after delivery
5.2 In the event of cancellation of an ordered order 2 weeks before the start of the execution, The Gridbuilder will charge the costs incurred for the preparation, ordering costs and logistics of the installation. This corresponds to 15% of the order amount with a minimum of 500 euros excl. VAT.
5.3 If the customer still wants to return the ordered materials 2 weeks after delivery, in addition to the disassembly costs, the call-out costs and shipping costs will also be charged. The customer is responsible for delivering in the original packaging to prevent damage to products. Any repair work to the building regarding disassembly will be borne by the customer.
5.4 The manufacturer and/or wholesalers may unexpectedly increase material costs on the hardware to be supplied if delivery and installation is postponed for a long time at the customer’s request. In that case, these will be charged to the customer
6 Complaints procedure
6.1 The Gridbuilder has a complaints procedure and handles a complaint in accordance with this procedure.
6.2 Complaints about the execution of the agreement must be reported fully and clearly to The Gridbuilder within a reasonable time, after you have discovered the defects.
